Dan was in shock. He had just found Diggy and now he had to give him up? How could this be happening? But the police would not be moved. Scott Underwood, the Chief of the local department later said in a statement to the press expressing that from their point of view, it was clear that Dan was breaking the law. As far as the police were concerned, the ordinance was not vague on what kinds of dogs were permissible, and they had a duty to enforce it. It looked like Dan might not have a choice.

If Dan kept Diggy he would potentially face a $500 ticket, or possibly even jail time. Plus, Diggy could then be forcibly removed from the home, which would be traumatic for everyone involved. So, Dan called up the shelter and informed them that he was going to have to bring Diggy back. But he hoped it would be temporary, because he wasn’t willing to give up Diggy without a fight. And thankfully it didn’t look like he would be in the fight alone.

Thousands of people had seen the original selfie of Diggy and Dan, and it had become a huge hit all around the country. Luckily for Dan, this might just help him in the end. When word got out that the police were forcing Dan to give Diggy back, it resulted in a huge backlash. People were stunned that such a law would exist, and that a sweet dog like Diggy would have to lose his home as a result. Diggy had made a lot of fans, and they wanted to help him.
